Welcome to kidscakes.co.ke (the “Website”). This Website is owned and operated by Happy Cakes Ventures (“we”, “us”, “our”). These Terms and Conditions govern your use of our Website and the purchase of our products.
By accessing, browsing, or placing an order on this Website, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with these terms, you should not use this Website.
2. Products and Services
- Product Description: We specialize in creating custom cakes and baked goods for children’s events. We strive to ensure that all product descriptions, photographs, and prices are accurate. However, as our cakes are handmade, slight variations in design, colour, and appearance may occur. All images on the website are for illustrative purposes only.
- Allergens: Our cakes are prepared in a kitchen where nuts, gluten, dairy, eggs, and other allergens are present. While we take precautions, we cannot guarantee that any product is completely free from allergens. It is the customer’s responsibility to inform us of any specific dietary requirements or allergies at the time of ordering. Happy Cakes Ventures will not be held liable for any allergic reactions.
3. Ordering and Payment
- Placing an Order: Orders can be placed through the online ordering system on our Website. To complete an order, you must provide accurate personal information, including your name, contact number, email address, and delivery details.
- Order Confirmation: An order is not confirmed until deposit amount or full payment has been received and you have received an official order confirmation from us via email or WhatsApp. We reserve the right to decline any order at our discretion.
- Pricing: All prices are listed in Kenyan Shillings (KES) and are inclusive of any applicable taxes unless stated otherwise.
- Payment: We accept payments via the methods specified on our Website, including but not limited to M-PESA, debit cards, and credit cards through our secure payment gateway.
4. Delivery
- Delivery Area: We currently deliver within Nairobi and its designated environs. Delivery charges will be calculated at checkout based on the delivery location.
- Delivery Times: We will do our best to deliver your order within the agreed-upon time slot. However, delivery times are estimates and cannot be guaranteed, especially due to unforeseen circumstances like traffic.
- Recipient’s Responsibility: It is your responsibility to ensure that someone is available at the specified delivery address to receive the order. If the recipient is not available, our driver will attempt to contact you. If we cannot complete the delivery, the cake will be returned to our premises, and a new delivery will be subject to an additional charge.
- Acceptance of Goods: Upon delivery, the risk of damage to the product passes to you. You are advised to inspect the cake upon arrival. By accepting the delivery, you confirm that the product is in good condition and as per your order specifications.
5. Cancellations, Refunds, and Alterations
- Cancellation by Customer:
- Cancellations made more than 48 hours before the scheduled delivery time will receive a full refund.
- Cancellations made between 48 and 24 hours before delivery will receive a 50% refund.
- Cancellations made less than 24 hours before delivery are non-refundable, as ingredients will have been purchased and preparation may have begun.
- Order Alterations: Any requests to change your order (e.g., design, size, flavour) must be made at least 76 hours before the delivery time. We will accommodate changes where possible, but they are not guaranteed and may be subject to additional charges.
- Cancellation by Us: We reserve the right to cancel an order in unforeseen circumstances. In such cases, we will notify you immediately and provide a full refund.
- Refunds on Dissatisfaction: If you are not satisfied with your order upon delivery, you must notify us immediately and not accept the cake. We will not be responsible for any issues reported after the cake has been accepted.
6. Use of the Website
- You agree to use this Website for lawful purposes only.
- You must not use the Website in any way that may cause damage to the Website or impair its availability.
- All content on this Website, including text, graphics, logos, images, and cake designs, is the property of Happy Cakes Ventures and is protected by intellectual property laws. You may not reproduce, copy, or distribute any content without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, Happy Cakes Ventures shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our products or Website. Our total liability to you for any claim arising from these Terms and Conditions is limited to the amount paid by you for the product in question.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of the Website after such changes constitutes your acceptance of the new terms.
